Yarborough Applegate Releases South Carolina’s First-Ever Insurance Bad Faith Book

When we pay our insurance premiums, we trust that our carrier will hold up its end of the bargain and be there for us in a time of need. Unfortunately, this isn’t always the case. “Bad faith” refers to an insurer’s attempt to renege on obligations to its clients, either by refusing to pay a legitimate claim or to investigate and process a claim within a reasonable time frame. Now, our very own David Yarborough and Reynolds Blankenship, two of South Carolina’s well-known bad faith plaintiff lawyers, are sharing some of their hard-earned insights with our peers. They recently wrote the playbook on the subject: Insurance Bad Faith: A Primer on the Law in South Carolina. In fact, it’s the state’s first-ever tome on the topic. To celebrate the book’s release, the South Carolina Bar is hosting a launch event and CLE this Friday, September 30, where Partner David Lail will join Yarborough and Blankenship and present on Non-Auto 1st Party Bad Faith Claims.

Insurance Bad Faith: a Primer on the Law in South Carolina

Part history, part primer, part practice guide, this new release addresses the intricacies and idiosyncrasies of this nuanced field of law, covering fundamental concepts and analyses the courts employ in evaluating bad-faith claims in various scenarios. Spanning 17 chapters, it has been two years in the making. 

We hope its release will serve to further elevate South Carolina’s legal profession and help victims gain a strong voice against insurance companies acting in bad faith. 100 percent of royalties from book sales will benefit Charleston Legal Access, the state’s first and only sliding-scale nonprofit law firm, which serves to bridge the gap for low-income individuals in need of legal services.

Insurance Bad Faith: The Law in S.C. Event Information

This week’s CLE and launch event will offer attendees the opportunity to learn from distinguished faculty representing both the plaintiff and defense perspectives. Topic will include third-party claims and damages (Tyger River), the objectively reasonable standard for an insurer’s good/bad faith, standing needed to bring a claim, insurance defense counsel’s perspective, and more. A roundtable discussion on default judgment, insurance bad faith, and the role of personal counsel, and ethical issues will also be held.
