David has collected jury verdicts and settlements totaling hundreds of millions of dollars for his catastrophically injured clients in cases involving bad faith against insurance companies; product liability from automobile rollovers and industrial machine injuries; toxic chemical spills by railroad companies; pool drownings; medical, dental and hospital malpractice; trucking and auto accidents; nursing home and daycare negligence; air and water borne bacteria exposure causing Legionnaire's Disease; dram shop negligence by bars and restaurants for violating alcohol liability laws; and negligence by retail stores, energy companies, apartment complexes, hotels, and construction contractors for job-site, balcony collapse and premises injuries. He and his law firm were recently recognized by VerdictSearch for achieving one of the top 100 verdicts in the United States stemming from their $35.9 Million Dollar verdict against PEPCO in Montgomery Co., Maryland. His practice today focuses on representing people who have suffered catastrophic injuries or death.
Year after year, David has been named among the Top 10 Super Lawyers in Charleston and Top 25 in South Carolina. He also has received the highest available peer review rating (AV) through Martindale-Hubbell and has been rated Preeminent for Legal Ability and for Ethical Standards by his peers. Additionally, he was nominated and chosen to serve on the South Carolina Bar's Judicial Qualification Committee which screens candidates for judicial vacancies. He is a frequent speaker on topics ranging from traumatic brain injuries to dram shop liability to trial techniques. He recently published a book for the South Carolina Bar titled "South Carolina Dram Shop Litigation: A Practice Guide." He is a member of the South Carolina Association of Justice, the American Association for Justice, serves on the Board of Trustees for Trident Technical College's Foundation, the Charleston County Bar Mental Wellness Committee and is on the Board of Regents of TriCounty Family Ministries. For the past twenty-five years David has been involved daily in mentoring and counseling of people suffering from alcoholism and addiction who are seeking recovery. David and his law firm place a large emphasis on giving back to the local community both by doing free legal work and through generous financial and service contributions to local charities each year. He and his wife Jessica are both natives of Charleston and have four children.
Prior to founding Yarborough Applegate, David was a Partner at another Charleston-based law firm where he was part of a national trial team defending products liability cases in trials across the United States. His experience of having handled national litigation, and having represented both plaintiffs and defendants in state and federal courts around the country provides him a varied perspective in discovery strategy, negotiations, and trial.
