Vehicle Injury at Power Plant Verdict

The Case: Our client, a truck driver, was injured when his foot was crushed by a vehicle being driven by the defendant at the entrance to the local Flakeboard plant, where the defendant was working. Our client had parked on the weigh scale at the plant entrance and had just
exited his truck when he was hit.

Following the foot crush injury, our client required over $200,000 in medical treatment and underwent four surgeries. He also developed a chronic debilitating condition called Complex Regional Pain Syndrome (CRPS). Doctors who diagnosed and treated our client's CRPS testified that our client will require a lifetime of future medical treatment and is 100% vocationally disabled.

The Outcome: Though the driver was employed by McCarter Electrical, a North Carolina electrical contractor who was performing work at the Flakeboard plant. Suit was brought against each. And while the driver and McCarter Electrical initially denied any responsibility—McCarter Electrical argued that the driver was not working at the time of incident—the jury determined that the driver was in fact working at the time of the incident. They apportioned fault 70% to the driver and McCarter.
