Settlement for Commercial Motor Vehicle Collision

The Case: In August 2020, our client was driving in Bennettsville, South Carolina, when a tractor-trailer ran a red light at S.C. Highway 9 and Oakwood Street, causing a T-bone collision with our client. The collision left our client multiple orthopedic injuries that required two hand surgeries and 26 months of treatment.

The Outcome: The truck driver initially provided a story that was inconsistent with the account of an eyewitness to the incident. When a plain-clothes law enforcement officer approached, the truck driver said he “tried to beat the light.” While the tractor-trailer was equipped with a dashcam, the trucking company misplaced the SD card that contained video from the date of the collision. Despite our immediate requests to preserve the video, the company was unable to produce it. However, the truck driver's cell phone records, which we obtained via subpoena, revealed he was on his phone at the time of the collision.
