David Lail Speaks about Representing Victims of Drunk Driving at Charleston School of Law Event

Yarborough Applegate’s David Lail was invited to be a speaker at The Charleston School of Law’s Healthcare Law Society and “Law Students United Against Drunk Driving” Annual Alumni JD-MD Meet and Greet Dinner on November 14, 2019. Lail’s talk focused on representing victims of drunk driving, as well as the dangers of unsafe alcohol service.

With the holidays approaching, as well as December being National Drunk and Drugged Driving Prevention Month, the talk was a timely and educational discussion about how to handle these difficult cases.

“Drunk driving and the over-service of alcohol by restaurants and bars are public safety issues,” Lail says. “When restaurants and bars fail to safely serve alcohol and turn patrons into drunk drivers, everyone on the road is put at risk. Thankfully, South Carolina has “Dram Shop” laws that allow victims of drunk driving to hold bars and alcohol retailers financially accountable for the damages caused by an intoxicated customer.”

A common misunderstanding following a drunk driving collision is that the only compensation available for victims comes from pursuing a claim against the drunk driver. However, South Carolina dram shop laws, and new legislation requiring at least $1 million of insurance coverage in many scenarios, provide for additional victim compensation.
