The Outcome: Yarborough Applegate obtained this settlement in U.S. District Court from Bankers Standard Insurance Company in a first-party bad faith case brought by one of its policyholders. The insurance company—ignoring evaluations from the lawyers it hired to defend its policyholder in the underlying case—put its interests ahead of the policyholder and coerced her into a position where she had to personally contribute millions to settle an underlying lawsuit against her on the eve of trial, to avoid potential financial devastation that could have followed an adverse verdict. Total and complete capitulation by the insurance company occurred only six months after we filed this lawsuit and took an aggressive discovery strategy.
