Yarborough Applegate’s David Lail Talked Dram Shop Risk On SCPR

Yarborough Applegate lawyer David Lail talked with South Carolina Business Review’s Mike Switzer on the South Carolina Public Radio about “Dram Shop” risk and liability in South Carolina.

Dram shop law in South Carolina creates a mechanism for victims of drunk driving accidents to hold restaurants and bars financially accountable and is a practice area the attorneys at Yarborough Applegate are passionate about.

Switzer and Lail chatted about the burgeoning food and beverage scene in Charleston and the potential risk for dram shop violations both in Charleston and across the state of South Carolina. The two also discussed Yarborough Applegate’s work to compensate victims and help bring awareness to these violations.

According to Lail, a common misunderstanding of drunk driving victims is that the compensation available to them can come only from the drunk driver, which many times is not the case. Instead, under S.C. dram shop laws, bars and restaurants can also provide a source of monetary recovery for victims when those establishments over-serve a patron that they should know is already intoxicated and later gets behind the wheel and injures the innocent.
