Yarborough Applegate Secures $1M Settlement for Pedestrian Hit by Car

South Carolina Lawyers Weekly Magazine reports that Yarborough Applegate has secured a $1 million insurance settlement for injuries an 84-year-old man sustained when a sport utility vehicle struck him while he was vacationing on Seabrook Island.

The victim, Robert Hunter, was walking along the shoulder of High Hammock Road on a January afternoon when the SUV made an abrupt U-turn and hit him, according to his attorney, David Yarborough.

He said the driver, Cara Lomas, told police that she had been looking at a pile of mail on the front passenger’s seat and had missed her turn, just before she made a U-turn and crossed Hunter’s path.

Hunter was air-lifted to the Medical University of South Carolina (MUSC) in Charleston, where he was treated for a fractured skull, orbital bone, ribs, an injured kidney, and a mild traumatic brain injury.

Hunter spent a week at MUSC and was then transferred to Roper Hospital for another 44 days. He spent two weeks at home before he was forced back to MUSC for 10 days for blood clots in his legs.

Now, Hunter, a Maine resident, requires a walker to move about and takes prescription medications for pain, dizziness and nausea. He also has frequent bouts of confusion and memory loss, Yarborough said.

His hospital bills total more than $206,000, which does not include home health care or physical therapy costs.

According to Yarborough, the driver’s insurer paid Hunter the $50,000 limit on her policy and Hunter’s underinsured motorist policy tendered another $950,000.
