Injured While Riding In An Uber or Lyft

Ride share apps like Uber and Lyft have seen a surge of active users in recent years. It’s not uncommon or impossible for accidents to occur while ride share users are passengers in these vehicles. If you find yourself in this situation – a passenger in a vehicle that isn’t your own, with a driver you don’t know but have hired for the job – it can be a difficult situation to navigate. Here’s what we recommend you do if you find yourself in an Uber or Lyft accident.

1. Seek medical attention as soon as possible.

If you believe you have sustained any injuries from the accident, it is important to call 911 immediately. Even if you believe your injuries may not be severe, you should still err on the side of caution, as experiencing the crash can raise your adrenaline and mask symptoms of an injury.

2. Contact the police.

Be sure that either you or another party involved in the accident contacts the police. A formal incident report must be completed by local law enforcement. Be sure to ask for a case reference number and the name of the officer on the scene.

3. Obtain information from the Uber/Lyft driver and other vehicles involved. Document the crash and your injuries as you are able.

It is important that you personally gather as much information about the accident as you are able. Be sure to record the names of each driver involved in the crash, and note the time and location where the accident occurred. With your cell phone, try to take photos of the accident, the cars, and your injuries as you are able.

4. Report the incident in the app.

Both the Uber and Lyft apps allow for an accident report within the application itself. It is important that you fill out this report with as much detail as possible.

5. Keep track of all associated expenses.

Be sure to keep documentation of all expenses accrued as a result of the accident. Medical bills and lost wages reports are common examples of damages that you may be entitled to.

6. Contact a personal injury lawyer.

It is important to contact a personal injury lawyer right away. As with other personal injury cases in South Carolina, a statute of limitations does apply to car accidents and collisions. Oftentimes these are complicated cases, as they can involve both the insurance of the ride share company, the driver’s personal insurance, and perhaps your own auto insurance, so it is important that you contact a lawyer to help navigate this type of situation.
