Douglas Jennings’ Article Published in National AAJ Journal of Trucking Litigation

Yarborough Applegate’s own Douglas Jennings was recently published by the American Association for Justice’s Trucking Litigation Group in its Journal of Trucking Litigation. This elite, specialized group supplies its members the tools and resources necessary to successfully litigate trucking and other commercial motor vehicle cases. Jennings’ article, Cell Phone Evidence in Trucking Cases: Back to Basics, covers best practices for preserving, obtaining, and using cell phone evidence in a case. It’s a topic Jennings knows well from years working cases and presenting to peers on the practice area.

The significance of driver cell phone evidence in trucking cases is well-known to trucking lawyers, but its importance cannot be overstated, Jennings acknowledges. After all, revisiting the fundamentals—here, keen knowledge of applicable federal regulations, understanding of industry standards and operational realities, recognition of layered insurance dynamics, and the strategic ability to weave separate facts into a compelling narrative—can make all the difference in a trucking or commercial motor vehicle case. And working those fundamentals into a sound strategy quickly is especially critical in cases involving time-sensitive cell phone data.

The amount of information cell phones contain is endless but is constantly being overwritten. Acting fast to preserve and collect cell phone evidence can make or break a big truck accident case. Not only can it prove whether a driver was on the phone at the time of a crash, but app usage data can prove whether a driver is fatigued or distracted, or even manipulating trip records and driver logs.

He recently attended the esteemed Academy of Truck Accident Attorneys’ annual conference in Austin, Texas. This past summer, the Kentucky Justice Association invited him to speak & present at its annual convention on preserving and utilizing cell phone evidence in trucking cases, and has presented to several other law firms on similar topics.
