Attorney Liam Duffy’s Article Published in SCAJ Justice Bulletin Magazine

Yarborough Applegate attorney Liam Duffy continues his thought leadership amongst trial lawyers in his latest published article, “The Golden Rule in Opening Statement and Closing Argument: What It Is and What It Isn’t.” Duffy’s article—which was published in the South Carolina Association for Justice’s Winter 2021 Justice Bulletin magazine—reviews the nuances of an importance concept that every courtroom lawyer should know: The Golden Rule.

In society, few concepts are as well-known and ubiquitous as The Golden Rule: Do unto others as you would have them do unto you. In trial, this rule refers to the prohibition of attorneys asking jurors to place themselves in the shoes of the plaintiff or victim. Duffy’s article discusses the mechanics and scope of this well-known rule, and aims to debunk certain myths about how it is often misinterpreted or misunderstood.

Duffy’s article draws on his first-hand trial experience in courtrooms across South Carolina, and reminds other trial lawyers of the importance of going back to the basics from time to time—as even the most fundamental of rules can be subject to extreme and erroneous interpretations.
