Yarborough Applegate Secures $6.45 Million Settlement in Wrongful Death of Motorcyclist Killed by Road Construction Defect

Yarborough Applegate recently secured a $6.45 million settlement for the family of a motorcycle rider who was killed by a road construction defect in Marlboro County, South Carolina. 

Attorneys John Dodds and Douglas Jennings worked alongside co-counsel of the Law Office of Todd Ellis and Doug Jennings of the Douglas Jennings Law Firm on the case. 

In June 2021, the motorcyclist was traveling through Bennettsville, South Carolina, en route to his home in Myrtle Beach. Unbeknownst to him, he was passing through an unmarked and unlit road construction zone that contained an excessive drop-off in the roadway. When he encountered the excessive drop-off, it caused him to lose control of his motorcycle. He crashed in the roadway, became trapped under his motorcycle, and died due to mechanical asphyxiation. 

After three years of hard-fought litigation—and on the eve of trial—the parties reached a global settlement.
