Yarborough Applegate & Clark Law Firm Obtain $1M Settlement in Civil Rights Case

Yarborough Applegate and Clark Law Firm recently obtained a $1M settlement for a wrongful death lawsuit in Florence, SC against the SC Department of Disabilities and Special Needs and the Pee Dee Regional Center.

Fantasia Franklin was a 21 year old, permanent resident of the Pee Dee Regional Center in Florence, South Carolina. The Pee Dee Regional Center is owned and operated by the South Carolina Department of Disabilities and Special Needs. Fantasia suffered from autism, among other medical and mental health conditions, and became a resident of the Pee Dee Regional Center in 2003. In this lawsuit the Plaintiff alleged that on or about December 12, 2013 Fantasia was improperly restrained by employees of the Pee Dee Regional Center and as a result died from compressional and/or positional as asphyxia.

C.L.F. and Y.A. filed a wrongful death lawsuit alleging violations of Fantasia’s federal civil rights on behalf of the Franklin family. There was a $1 Million liability insurance policy in place that covered all defendants. SCDDSN’s liability was capped at $600,000 due to governmental immunity, so the remaining $400,000 was paid on behalf of the SCDDSN employees who restrained her.
