Recently, Yarborough Applegate’s Douglas Jennings and David Yarborough, along with co-counsel M. Travis Hyman, reached an $800,000 settlement in a case involving a tractor trailer collision in Horry County.
The recently-settled case was on behalf of a Horry County nurse returning home in a car with her daughter and son-in-law. Their vehicle was struck by a tractor-trailer from Carolina Prestress Corp at a rural intersection. The family involved in the crash sustained serious injuries and incurred significant medical bills. The legal team argued that the driver of the truck exceeded maximum safe driving hours per Federal Motor Carrier Safety Regulations. During the case proceedings, Jennings found questionable documentation of the driver’s hours on the job – noticing that some time card logs for the at-fault driver were scratched out and conflicted various other time-stamped documents. The changes could not be accurately accounted for by Carolina Prestress Corp. and it was evidence that the driver of the tractor trailer was fatigued and in violation of the Hours of Service Rules under the federal statute.
