Yarborough Applegate recently earned a $1.35 million settlement for our deserving client who was injured in a car wreck—after his insurance originally offered just $35,000.
Our client, who had been previously diagnosed with Parkinson’s Disease, was traveling on Highway 17 in Meggett, South Carolina, when his vehicle was rear-ended by a drunk driver.
The minimum limits liability carrier tendered its $50,0000 liability insurance limits. However, our client’s Underinsured Motorist (UIM) insurance carrier disputed the claim that the wreck caused an increase of hand tremors relative to Parkinson’s. Our client only had $21,000 in orthopedic and neurology care, but it was his more prominent tremors after the crash that represented the most significant change in his life. Our client’s insurance carrier originally only offered $35,000 to resolve the claim.
And that’s when Daniel Summa of Summa Law Firm asked Yarborough Applegate to get involved.

We secured dashcam video from the DUI arrest, which told the only story that really mattered. “Whether the increased tremors were caused by the wreck was a non-issue in my mind,” Lail says. “This case was about conduct and an appreciation for what actually drives value in a case. Instead of paying the $35,000 they offered early on, the UIM carrier ultimately paid $1,350,000 to a really great client.”
