Attorney Liam Duffy Presents at Kentucky Justice Association Seminar on Unique Premises Liability Cases

Last week, Yarborough Applegate attorney Liam Duffy was invited to present to members of the Kentucky Justice Association as a featured speaker at a seminar on litigating complex premises liability cases. Duffy’s talk, “Third-Party Premises Liability in Workplace Injuries & Deaths,” addressed handling premises and products liability in workplace injury settings.

Plaintiffs’ counsel should leave no stone unturned when investigating potential premises and other third-party claims in the workplace injury context, especially where the damages are catastrophic or fatal.  Unfortunately, many of these cases go undetected and claimants or their families may be left with the limited—and often inadequate—remedies provided by the workers compensation system, Duffy shared. He drew on recent experience litigating a variety of third-party premises cases, including a powerline electrocution case, scaffolding falls and construction site injury cases, and other unique situations where individuals were seriously injured due to the unsafe condition of another’s property. He also addressed the importance of swift and thorough investigation and working with OSHA and employers to preserve evidence.

Premises liability doesn’t just refer to just slips, trips, and falls. Instead, this broad category describes any situation where an individual or corporate property owner, manager, or anyone else who creates or controls a dangerous property condition may be responsible for injuries due to a lack of reasonable safety measures or warnings about the unsafe property condition. Meanwhile, products liability refers to the liability of any parties along the chain of manufacture of a product for damage it causes to an individual.
