$3 Million Settlement for Cyclist Killed By Drunk Driver

Our client, a friendly, health-conscious, respected construction worker, was riding his bicycle home from work when he was struck and instantly killed by a drunk driver. After fleeing the accident, the driver, who was using his company’s vehicle, was apprehended by police and charged with felony DUI.

An investigation revealed that the driver was under the influence of beer, liquor, and prescription medication and had a history of alcohol-related misdemeanor and felony convictions. The employer’s insurance company sought to avoid coverage of the claim and the employer claimed no prior knowledge of the driver’s history of drinking and driving. The case was settled at mediation for $3 million.
