$2.75 Million Settlement Reached for Injured Motorcyclist

Yarborough Applegate attorneys Douglas Jennings and Liam Duffy, alongside Gerald Hamon and Jase Felts of Hamon & Felts, recently secured a $2.75 million settlement for a motorcyclist who was injured after a driver struck him while making a turn across oncoming traffic.

Our client was driving his motorcycle on Kings Highway in Myrtle Beach in October 2017 when a driver in the highway’s middle lane attempted an abrupt left turn in front of him, striking his motorcycle and launching him into the roadway. Our client skidded nearly 40 feet before coming to a stop.

As a result of the crash, our client suffered serious injuries to his right arm and right knee. He required several surgeries for his right arm, and because of radial nerve damage, suffered a loss of sensation in his fingers, hand, and wrist. For several months, he had to wear an outrigger-style splint that suspended his fingers with rubber bands on his right hand. The 35-year-old’s injuries ultimately forced him to give up his job as a furniture mover. His inability to return to the workforce doing manual labor became a focal point of the litigation.

The defendant was driving her mother’s car, which had an underlying policy of $500,000. The defendant also had her own at-home policy of $500,000 along with a $2 million umbrella policy.

“This was a fairly straightforward liability case and the defendant’s counsel recognized the potential risk of an excess verdict even though the defendant had more insurance coverage than the average driver,” said Jennings. “As a result, the case resolved at the right stage of litigation which eliminated the uncertainty of a trial in the best interests of both the plaintiff and defendant.”

To help the insurance companies understand the significant impact of our client’s injuries, we provided him with a GoPro camera and asked him to document the many challenges he faced in daily life after the motorcycle wreck.

This firsthand video evidence proved extremely powerful. As compared to the often-sterile information found in medical records and expert accounts, it brought to life the human consequences of this accident. The videos showed how our client struggled with basic activities that most people take for granted, like sleeping, getting dressed, and preparing lunch for his children.
