Yarborough Applegate recently achieved a $1.45 million settlement for a commercial truck driver after he was catastrophically injured in a big-rig collision.
Yarborough Applegate attorneys William Applegate and Douglas Jennings along with Andy Savage of the Savage Law Firm, represented Sammie Scammahorn, a commercial truck driver who sustained multiple serious injuries after a collision accident in 2013 at the Charleston Port.
According to court documents, Scammahorn was injured while making a delivery at the Charleston Port during a rainstorm when another tractor-trailer ran through an intersection, t-boning Scammahorn’s rig. Scammahorn sustained skull and facial fractures, cracked ribs and a broken pelvis in the accident. The 57-year old is now unable to return to work.
Murray Sexton, the alleged at-fault driver involved in the accident stated in response to the suit that his employer, Big Boy, had failed to properly train him causing him to be unaware of the ‘stop’ markings on the pavement at the port and unable to see the paint in the rain.
According to court documents, Scammahorn’s attorneys and their experts maintained that Scammahorn displayed signs of mild traumatic brain injury following the accident. Despite medical professionals insisting Scammahorn was not fit to return to work, he took the certification exam in hopes of returning to his job. Scammahorn did not pass the physical aspects exam and at the time of the settlement had accrued $165 thousand in medical bills and was still receiving treatment.
“This money will make up for the harms and losses that Mr. Scammahorn has suffered including past medical bills and lost wages. It will also relieve him of the stress and financial burden of not being able to work in the future and allow him to pay for future medical treatment” according to his attorney William Applegate.
According to court documents, Big Boy Trucking, Madison Intermodal, Inc., Wall Street Systems, Inc., and Murray Sexton received a release of all claims in exchange for $1.45 Million. The settlement was approved after a hearing by Circuit Court Judge Dennis Markley in May of 2016.
