Lail Presents to NALA on Dram Shop Cases

The Yarborough Applegate team is passionate about the prevention of drunk driving and helping those whose lives have been affected by this unfortunate and highly preventable crime. Our attorney David Lail represents victims of drunk driving in an niche practice area called Dram Shop law. In the fall of 2016, he wrote a book on the topic for fellow lawyers and in early May, led the first of two webinars hosted by The National Association of Legal Assistants (NALA) which was moderated by our paralegal Amy Johnson, “What is a Dram Shop Case and Do I Have One?”

The webinar’s first section on May 10 reviewed the history of Dram Shop Law, helped attendees determine if they have a Dram Shop case, and advised on beginning to collect evidence. Part two takes place on November 17, 2017 and is slightly more advanced, focusing on comprehensive data collection, finding and calling on the right experts, and using these critical parts and pieces to build a valuable case.

Lail’s presentation reviews a Dram Shop case from start to finish, clears up misconceptions about liquor liability, shares technical insight into the toxicology of ethanol, and ultimately helps attendees build a case that proves the fault of the establishments or event hosts responsible for over-serving patrons or guests who later inflict harm or death while operating a vehicle while under the influence.

Webinar attendees will gain real-life practice tips for handling the common and not-so-common issues encountered in Dram Shop cases. Handouts include sample verdicts from across the nation, checklist of relevant evidence, sample subpoena and cover letters to request medical records and toxicology results for the drivers, and resources for how to check the applicable laws and statutes in your state. These webinars are ideal for professionals in plaintiff law, but also offer helpful insight for defense attorneys, paralegals, and firms.
